These General Terms and Conditions of Sale govern purchases made through the website operated by S.A.C. Rappresentanze di De Pace Domenico & C. S.a.s. Before placing an order, customers are invited to read this document carefully.

2. Scope of application

These General Terms and Conditions apply to all purchases made through the website.

By submitting an order, the customer declares that they have read, understood and fully accepted these Terms and Conditions.

The provisions contained in this document apply without prejudice to any mandatory rights granted to consumers under the laws in force in their country of residence.

3. Products

Photographs, images, descriptions, technical data sheets and other product information displayed on the website are provided for illustrative and informational purposes.

Although every effort is made to ensure the accuracy of the published content, slight aesthetic differences may exist between the images displayed and the product delivered, without affecting its technical characteristics, quality or functionality.

SIRGE reserves the right to make non-substantial changes to its products whenever necessary to improve their characteristics or comply with technical or regulatory requirements.

4. Product availability

Product availability shown on the website is regularly updated.

In exceptional circumstances, a product may become unavailable even after an order has been confirmed, for example due to simultaneous orders, computer errors, supplier delays or warehouse issues.

In such cases, the customer will be informed promptly and may choose, where available, between:

• a full refund of the amount paid;
• replacement with an equivalent product;
• waiting for the product to become available again.

5. Prices

All prices displayed on the website are expressed in euros.

Unless otherwise stated, prices intended for consumers include VAT at the rate required by applicable law.

Any delivery charges, additional costs or surcharges are clearly indicated before the order is completed.

In the event of an obvious pricing error, the seller will inform the customer before processing the order.

6. Payment methods

The order will be considered valid and effective only after payment has been confirmed or, where applicable, authorised.

7. Shipping and delivery

Orders are shipped through national and international couriers to the address provided by the customer during the checkout process.

Any delivery times shown on the website are estimates and may vary due to circumstances beyond the seller’s direct control, including courier delays, strikes, adverse weather conditions, public holidays, customs procedures or force majeure events.

Upon delivery, the customer is invited to check:

• the condition of the packaging;
• the absence of visible damage;
• the number of parcels delivered;
• that the goods received correspond to the order.

If visible damage is present or the packaging is open, crushed or damaged, the customer is advised to accept the delivery subject to a specific written reservation, describing the damage on the courier’s delivery document.

Any issues should be reported to the seller as soon as possible, together with photographs of the packaging and product where necessary.

8. Right of withdrawal and returns

Consumers have the right to withdraw from the contract within 30 days from the date of delivery of the product, without having to provide a reason.

To exercise the right of withdrawal, the customer must notify the seller of their decision by means of a clear statement sent using the contact details provided in this document or through the tools available on the website.

The product must be returned:

• complete with all accessories, components and manuals;
• properly protected and packaged;
• preferably in its original packaging;
• without damage beyond what is necessary to inspect the nature, characteristics and operation of the product.

The consumer is responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics and operation.

Unless the product is defective, non-compliant or was sent in error by the seller, the direct cost of returning the goods shall be borne by the customer.

The refund will be issued within the time limits and according to the procedures established by applicable law, after the goods have been received or after the customer has provided evidence that they have returned them, whichever occurs first.

9. Legal guarantee of conformity

All products sold to consumers are covered by the legal guarantee of conformity required by the law applicable in the country of sale.

Warranty period for B2C consumers:

• Italy: 24 months from the date of delivery of the product.
• Spain: 36 months from the date of delivery of the product, in accordance with applicable Spanish law.
• Other European Union countries: the period established by the applicable national legislation and, in any event, no less than 24 months from delivery.

Warranty period for professional B2B customers:

• 12 months from the date of purchase, unless otherwise required by mandatory law or agreed in writing.

The legal guarantee covers any lack of conformity existing at the time of delivery and becoming apparent within the period established by applicable law.

In the event of a lack of conformity, consumers are entitled to the remedies provided by law, in accordance with the order and conditions established by the applicable legislation, including, where applicable, repair, replacement, price reduction or termination of the contract.

The warranty does not cover damage resulting from:

• improper use or use contrary to the instructions;
• negligence, impacts, drops or accidents;
• incorrect installation or maintenance;
• normal wear and tear of consumable parts;
• the use of unsuitable accessories or spare parts;
• unauthorised alterations, tampering or repairs;
• damage caused by power surges, external factors or accidental events.

Any commercial warranty offered by SIRGE is additional to and independent of the legal guarantee and does not limit, replace or prejudice the rights granted to consumers under applicable law.

10. Technical assistance

The SIRGE Customer Service and Technical Assistance team can be contacted using the details provided in this document and through any support forms available on the website.

To allow faster handling of the request, the customer may be asked to provide:

• the order number or proof of purchase;
• the product model and serial number, where available;
• a detailed description of the issue;
• photographs or videos useful for diagnosis;
• any error messages displayed by the product.

Before authorising a return or technical intervention, the seller may carry out remote checks and provide operating instructions to determine the nature of the issue.

11. Proper use of products

The customer must use the products in accordance with the instructions, safety warnings and information contained in the user manual.

Products intended for household use must not be used for professional, industrial or other purposes for which they were not designed, unless expressly stated otherwise.

The seller shall not be liable for damage caused by improper, negligent, abnormal use or use contrary to the instructions provided.

12. Limitation of liability

The seller’s liability is limited to the circumstances and extent provided for by applicable law.

Without prejudice to the mandatory rights of consumers, the seller shall not be liable for indirect damage, loss of profit, loss of data, business interruption or loss of use of the product resulting from:

• improper use of the product;
• failure to follow the instructions;
• unauthorised alterations or interventions;
• force majeure events;
• events not directly attributable to the seller.

Nothing in these Terms and Conditions limits the seller’s liability in cases where such limitation is not permitted by law.

13. Intellectual property

All content available on the website, including, by way of example, texts, photographs, images, logos, trademarks, videos, catalogues, manuals, technical data sheets, software, graphics and layouts, is owned by S.A.C. Rappresentanze di De Pace Domenico & C. S.a.s. or by the respective rights holders.

Such content is protected by copyright, trademark and industrial property laws.

Any reproduction, distribution, publication, modification, extraction, reuse or commercial use of the content without the prior written authorisation of the relevant rights holder is prohibited.

Any amendments will take effect from the date of publication on the website and will not apply to orders already concluded, which will remain governed by the conditions in force at the time of purchase.

17. Applicable law and jurisdiction

These General Terms and Conditions are governed by Italian law.

For consumers residing in another European Union country, all mandatory provisions and rights granted by the legislation of their country of residence shall remain unaffected.

Any dispute involving a consumer shall be subject to the court having jurisdiction under applicable law and, in particular, to the court of the consumer’s place of residence or domicile where required by law.

For relationships with professional B2B customers, unless otherwise required by mandatory law or agreed in writing, the court having jurisdiction shall be the court of the seller’s registered office.

18. Alternative dispute resolution

The customer may contact the seller directly in an attempt to resolve amicably any dispute relating to a purchase.

Any alternative dispute resolution procedures made available under applicable national or European legislation shall remain available.
